Given Imaging Patent Upheld by USPTO

Following a challenge by Olympus, last week the United States Patent Office upheld 13 of the 17 claims in a major patent awarded to "Given Imaging", an Israeli Company that manufactures a miniature camera-in-a-pill. It is expected that "Given Imaging" will respond to the objections concerning the remaining four claims.

    Claims 1,2,3 and 11 are rejected.What is the significance of USPTO rejecting the first three basic claims of a system?Also it happened at a time when USPTO approved patent#
    7039453.Any opinion?
