Teva Pharmaceutical Industries Ltd., the Israeli drug manufacturer, has been granted final approval for its generic version of Roche’s Laboratories Inc.’s Kytril medication which is used to prevent nausea, vomiting and other side effects of radiation and other cancer therapy.
The generic drug infringes an existing patent, which Teva claims is invalid.
Being the first generic version to get FDA approval gives Teva a six month exclusive marketing period for the product. Barr Laboratories Inc. claim to have also received FDA approval, but will have to wait to until Teva’s exclusivity period ends before marketing the drug.
