Under Israel Trademark Ordinance Section 41, a third party can bring proceedings to void a trade or service mark not in use for 3 years. Israel clothing company Vampoom successfully challenged Israel Trademark No. 101663 to GIGIESSE CONFEZIONI S.p.A. claiming that the mark was not in use locally, and was also not sufficiently well known to be maintained based on foreign usage.
The mark was registered in Class 25, covering clothing, headgear, shoes and accessories.
The decision paves the way for Vampoom to get their pending aplication no. 174501 “UOMOZIP” and 174502 “DONNAZIP” approved. Furthermore, it is likely that the Israel company will now file their own application for the word “Zip”.
